We are a small truck repair shop (3 employees). We furnish 100% of employee's health insurance. Have 1 employee out on w/comp & this is the second time in 3 months. Was off a month first time now

Not only should you look at past practices, but you should look at what your health insurance contract states. They should define eligiblity in there. Some specifically state when a non-working employee must be moved off the plan (and on to COBRA) within a certain time period...others allow it more at the employer's discretion.
