Is it against the law to interview an applicant make a job offer. Explain how much you will be paid per hour. Ask for references tell the applicant when what day of the week the orientation would be held and where to do your drug testing. Ask for 1 personal reference and 2 business references and not call the applicant back on start date. Then reconsider the job offer is legal and can the applicant sue. The state is Tennessee.

Probably legal. If the applicant quit another job or turned down another offer in anticipation of this job, then there might be some recourse since there would be actual damages.

Was the job offer dependent on passing the drug test and whatever reference/background check there was? Many companies do contingent job offers to protect themselves. It is not illegal. But the offer should be stated as such. And it is only polite for them to tell you if they are rescinding it due to a failure in one or more of those areas.
