Does anyone know if there is a certified pre-employment testing tool (that complies with all laws) that can be administered that would assess “active listening” skills?

Hi:
I would contact the Association of Test Publishers in Washington, DC and it will be able to provide the names of publishers/consultants who work in this area. As an aside, tests are not certified and it would be misguided to say that any test complies with all laws--the validity, utility and lawfulness of a test depends on the components of the job. Finally, active listening skills will best be assessed by some form of oral interactive exercise, rather than a written test.
I trust this information is helpful.

Thanks Dave
Finding pre-employment validated testing is an uphill search. I appreciate your lead and Ill check them out. Having an interactive process during the interview would be difficult to asses because of all the ancillary pressures on the interviewee. Post hiring you can work on development, but if the person does not have a basic propensity, no matter how much training the employer provides they are still going to end up with a bad fit. Thinking about your answer, I probably asked the wrong question. If they are good active listeners they probably would evaluate very high on interpersonal skills. Im wondering now whether there is a validated pre-employment test that evaluates interpersonal skills.

I just attended a seminar and.... Don't you love those words.
Actually i was in an informational meeting where we discussed this very issue. This is one of the federal EEOC's hot topic's right now according to the people facilitating the meeting I attended. I am aware of some good products in pre-employment assessment that are available. they are tied to other products though. One of the best I have ever used is a product called prove it available from Kenexa. (I do not work for Kenexa, I just like their products)

Hi:
If the focus is on interpersonal skills, then there are various written tools that may be valid for your specific needs. As for the EEOC's current focus, the true focus has recently been systemic discrimination issues--not testing per se. This means that the agency is focusing on ensuring that hiring tools, which tend to exhibit disparate impact (e.g., criminal background checks, credit reports, cogntive abilities tests, drug tests, physical requirements, educational requirements, experience requirements) are job related and consistent with business necessity.
I trust these comments are helpful.

Dave is correct. the info session I attended focused on pre-employment testing and stated it was a focus of the EEOC. they did state that this was part of a broader focus, however, the caution in this instance, was pre-employment testing.

May I make a technical point? A test is not inherently valid. You can gather validity evidence for the predictive value of a test for a particular job in a particular organization. Since validating every selection test for every job is impossible in most cases, many assessment companies have data on the generalization of the validity of a test for a job or job family, eg customer service reps. I would recommend PDI but you better have a big budget.
