My company currently does not electronically track employee work hours. My employees record their work hours using a paper timesheet. We have an access system (employees are issued a swipe card) to enter the facility. A supervisor is questioning the work hours his employees are recording on timecards. Would there be any legal issues with the department manager to request his employees to swipe out of the facility when leaving at night in order for him to track their work hours for a period of time?

Absolutely not. You can have them swipe in and out all day long 'til the cows come home and this would be perfectly legal.

I concur and it can be an easy solution. Caution should be exercised though if employees routinely leave the buiolding for breaks such as smoke breaks or meal periods and then return. Obviously I don't know what the swipe report will look like but having domne this in the past this was the issue we faced. easily remedied though.

I agree that sounds like a good solution, except that I would be hesitant to use it for much more than comparison.
Because just because they are on-site doesn't mean that they are actually working and you would hate to get in a situation where they used that information against the company -- by claiming that they didn't get paid for all their hours.
