We are a small sole proprietor company with 3 employees. One has been off for 14 weeks now with a back injury, & the chiropractor still has him off for another 2 weeks or longer. We are to the point we have to replace him we can't go any longer with just 2 employees and don't forsee him being able to come back in the same capacity he has been diagnosed with degenerative back problems by a specialist. How do we get rid of him???

Yes, they say don't do anything til he's off W/C because he will drag W/C out, but he's already doing that. They medical Dr. didn't take him off work the chiropractor is the one that is keeping him off work. The back specialist did a MRI & said there is slight degeneration in 2 vert. & small bulge in one. Did not say he needed to be off work. We have replaced him & don't want to bring him back, can we just tell him he's laid off when he's released?

Laying him off now or wjhen he returns could be seen as retaliatory. Your WC carrier isn't helping uyou. Time to push them and explain not only why you need their help but that it is troubling to you that the only answer you are getting is don't do anything until he comes off WC. You need them to push the issue of "disagreeing Physicians"

I am surprised that your WC carrier is allowing the employee to use a chiropractor vs a orthopedic specialist. I agree with HRPro, your carrier needs to be helping you with this case.

The w/c people had him an appointment with an orthopedic specialist last week but he didn't show. Said he was lost for 5 hours and couldn't find the place so he went home. He had directions & the phone number but didn't call. W/C made another appointment for the 17th and said they were going to tell him if he don't show up for this appointment they are going to terminate his benefits.

Good chance you may be getting jerked around here. Chiropractors in California have been doing this for years and there's little employers can do about it. 2/3rds of a paycheck and a daily backrub is a pretty good deal for the employee, not for the WC carrier.
I agree with HRPro that your WC carrier is taking the right steps.
