We are a non-profit in MS. We, along with the public schools in our area, have great difficulty recruiting bus drivers. The public schools have been providing benefits for their drivers even though they are part-time. Our agency policy is to not provide benefits for PT employees (we only have about 3 other than bus drivers). If we decide to provide benefits for the PT drivers, but not the others, will we be violating any laws? I could not find any such laws. The other PT positions are for programs with budgets that could not bear the additional expense.

A lot will depend upomn how your organization is legally structured but in a nutshell it is very difficult to legally allow one group within an employee classification to receive benefits while excluding others in the same classification.
So the solution could lie within how you classify individuals. Perhaps creating a stand alone classification for Part-time Bus Drivers that is not tied to hours worked would be the direction. of course related issues could be your carrier and how they not only view the contract they have with you but also any requirements they may have, such as hours worked, in order to be eligible for benefits.
