Indefinite Furlough Notice-Question About Monies Due

My home state is California

I was recently put on an indefinite furlough with no definitive date to return to work. I was told that I could file for unemployment and there might be work in about 4-6 weeks. I was not given my paycheck or any of my vacation pay(over a 100 hours). I signed a form that only read employee status now "indefinite furlough".

I looked at the DLSE website and found these links that I think apply to my situation. They are straight off the Division of Labor Standrds Enforcement:

Im hoping that I have cause to go after my vacation pay since it would be a good chunck of cash.

Any help is greatly appreciated

I would suggest filing a wage claim, especially if you didn't receive your last paycheck.

It appears that "indefinite furlough" is being used as a euphemism for "layoff". You should file a claim with the Labor Commissioner.

It certainly appears that you have been layed off and you can file for unemployment. Regarding the vacation pay, does your company have a policy allowing you to cash in earned vacation? If so, I suggest you request that. Regarding your pay from the period last worked, I suggest you contact your HR/Payroll department and ask when you will be receiving that (likely in the mail).

California has MUCH stricter rules than most states about pay and payout of vacation. It sounds like your company is trying to pull a fast one by changing the name of what they are trying to do. While they can possibly use a temporary suspension/layoff, what you are facing does not sound temporary.

The employer has violated California wage and hour law by not paying out all monies due on the day of termination including vacation payout.

There is enough language in LABOR CODE
SECTION 200-243 on the DLSE website to make it obvious your employer owes you this money. I would strongly encourage you to go to or call the local office. You can find them at http://www.dir.ca.gov/dlse/DistrictOffices.htm

This sounds like something a former employer of mine used to try and do. They were wrong then too and frequently paid for that.

Thanks everyone for the replies. I spoke to a someone at the labor board and was told that I have a case. I filed a wage claim and hope to have this resolved real soon.
