I have a staff who went out on work comp from 9/20 to 10/7 and is collecting total temporary disability. I understand that these leaves will run concurrently with her FMLA. Will she be able to colelct

Worker compensation and FMLA

I have a staff who went out on work comp from 9/20 to 10/7 and is collecting total temporary disability. I understand that these leaves will run concurrently with her FMLA. Will she be able to colelct state disability insurance too when she is on this kind of FMLA and collect TTD? Also, do you have any suggestion on how i can word the letter to inform her of hte FMLA and her disability insurance....any help would be appreciated.

also, for FMLA we do not require staff to take PPL but ask if they want to use it. Can we do the same for this work comp related FMLA?

WC laws vary from state to state. Generally speaking, a person on WC collects WC compensation and does not collect any other disability pay.

Since the employee is getting WC compensation, there would be no reason to have the person use any accrued vacation/sick time.
