This is a doozy. We offered a position in writing to someone in Europe. He quit his position and accepted our offer. In the meantime, after consulting with p/r firms in that country, it was decided by the powers that be that they didn't want to invest the monies required to get this person off the ground so to speak.although HR did recommend that we wait before sending out the offer letter, the RVP of International sales demanded that it be done for fear of "losing " the candidate. This is without firming up approval from the upper management. Unfortunately, the person who signed the offer letter is also upper management but was not aware that the person who did not want to proceed felt that way. Since we are located in the US. can the candidate still sue us for rescinding the offer after he quit his position elsewhere?

He could but he would have to come to the US to do so. He might be able to sue you through his own country's (or the EU's) court system, and if he can - and does - you would have to go to his country (or the EU) to defend your case or risk losing by default. Which doesn't necessarily mean you'll have to pay anything, as long as you're prepared to never set foot/do business in that country (or the EU) ever again.

I reco that at this point you just wait and see what happens.

You should write down all your experiences with this company, get a publisher and sell it as "Clueless in Corporate Management" or something similar.

It's a wonder these people are in business to begin with.

Thanks Nork3 I love the idea-but, how can I make this amusing-I really dont' want to write a depressing book and so far, none of this nonsense is laughable.
