I was recently terminated from my position and noticed that my former employer pulled my vacation records from the payroll company website. The balance is substantial and amounts to over a month's paycheck so that I suspect the company is trying to claim I had taken more time off than I actually did in order to reduce their financial liability. What is the remedy? Who shoulders the burden of proof in this case? The company did not follow strict procedures in terms of requesting or reporting vacation time. I am based in California. Thank you

Generally it is the employers responsibility to maintain records of all time worked, time off, etc. My advice to you is to report your concern to http://www.edd.ca.gov/Unemployment/
