WE have employees who are here on visas. As is the policy, when hired they are given an offer letter. In the letter it states what their position will be. When they come here on an OPT and are changing to an H1, they have to produce the offer letter. Because we might not pay them what the going rate is for their position, when paperwork is filled out for the H1, the job title is changed.They are now talking of producing another offer letter to be used strictly for the visa changes. My question is, above all, this seems dishonest to me, but, lets say somewhere in the future, that same person becomes angry with the company and he puts a claim into the labor board basing the fact that he has an offer letter showing a position which is a higher paid position and he would like to get his back pay. In reality, that letter was only made to match his visa papers. Would they have a legit claim to the labor board? My feeling is-don't change any title, the title he came with is the title that should show-not a fake one. Please help??

I have to wonder if there could be potential problems were HHS to find out about this practice. Seems very fraudulent.
