We have a verified case and two possible cases of H1N1 in one of our residential clients. An employee went to their supervisor asking to go home since they have a four month old baby at home and reports say that the very young and very old can die from H1N1. We let them go home,

They asked to be informed when fever was absent for 24 hours so they could return to work without concern of infection.

They tried to contact staff to get updates, but phone calls and emails were not returned and they had no way to know what was going on with the H1N1.

Then the head of the department told them to return to work or be terminated.

Is this legal?

It's legal - but very bad bad bad practice.
