If a small company has multiple employees, all living in different states, and the work is all at clients sites in various states, what state labor laws apply? There is no physical HQ office from which an employee works. It is either at home or at a client site.

The state in which the work is performed. That means you'll have to deal with the state laws in those states in which you have employees.

And many companies who face this same issue find the state in which the laws are most favorable to the employee (usually California) and go from there.

But do realize that some states/localities have differing taxes and employee benefits laws such that you would still need to make sure that those were being done correctly.

As much as it pains me to type this, but this might be the time to look into a PEO that can handle differing state laws, benefits and taxes for you. Because it is had for one person to have the knowledge needed to do HR/payroll correctly for a small amount of employees in multiple states.

Thank you both.
That is what I assumed, but wanted to double check.
Thankfully I am in CA and very familiar with all the laws here. Still, it will take some time and research to ensure multi-state compliance.

The good news is that most states don't have as whacked out labor laws as does California (some of the northeast states come close, though). You'll also find that a lot of southern states have minimal state labor laws.
