Do any of you use seasonal employees (non-agricultural)? My employer likes to lump seasonal and non-exempt together as a category, and I remember hearing somewhere that they were different categorizat

Do any of you use seasonal employees (non-agricultural)? My employer likes to lump seasonal and non-exempt together as a category, and I remember hearing somewhere that they were different categorizations - or I've just convinced myself. One way or the other, I need a good, definite answer to share with my HR manager. Thanks.

It appears that "seasonal" is very narrowly defined.

A category for what purpose? Employment, pay, benefits? It is going to depend on how he wants to use the category.

For example, your health insurance could class out seasonal employees, without classing out non-exempt employees. But your 401k plan will have specific rules on eligibility dependent on total work hours in a year, regardless of a "seasonal status". Granted a lot of seasonal/temp employees would never meet eligibility, but if one did, you would have to allow them to participate.

There are some seasonal employees that could be paid differently under FLSA, but like the previous poster stated, that is a very very specific group with very specific rules.

So unfortunately there is not a one-size-fits-all answer here.
