i know my new company is doing the wrong thing, identifying applicant's race by sight. no supplemental data sheets. as a result, applications may not be mailed out. my understanding is that being identified is voluntary, the applicant choice how and if. I cannot find this in writing. HELP!

According to the OFCCP all applicants need to be tracked according to sex and race. That means that even if the applicant refuses to fill out the self-identification sheet a presumption must be made to answer those questions. That needs to be done by sight, locality whatever to get that information.

Luvtasurf is absolutely correct in stating that race needs to be tracked. This is for internal/ auditing purposes only. It becomes an issue when the applicant is discriminated upon based on race. You are also correct in your assumption that your company is practicing an ilegal act by identifying race by sight. Not only may they be incorrect in their guess, ( believe it or not, it happens all the time) for auditing purposes (especially if you are ISO compliant) the applicant must agree in writing to divulge this information. If it is found in your database without the proper paperwork to back it up, it could turn into a nasty discrimination suit, or your office could be fined for incomplete paperwork. If you have a corporate backing, check with your companies legal department. Your office should have a standardized policy and procedures manual in- house. There may be information in that as well. But definitely, INVESTIGATE.
