Don't foget that all criminal background screens are conducted post-offer (contingency offer). However, as part of Title VII of the Civil Rights Act, this information cannot be used as a basis for denying employment, unless it is determined to be job-related.

There are lots of background screening companies out there. That means that there is considerable variation in the rigor and quality of a background screening. Here are a few things to look for in a background check company to help you discover which are the keepers.

1.) How extensive are the instant searches?
Do they start with an Address history search? Are all states and counties accessible?

Background checks are not illegal as long as the checks are related to the job functions.Depending on what type of checks are required, there are different ways to do these, a) in house, b) outsource (in Canada BackCheck is one of them),c) in some cases such as criminal record check and driving record abstract, we have asked the applicant to do his/her own and bring in the result.

My only concern about Verifications Inc is that I have heard that the head of the sales department likes to respond to blogs plugging his company. I also heard he has a giant melon on top of his shoulders.

If you use an outside ageny you may want to check on www.concernedcras.com and see if they are a member. They profess:

ConcernedCRAs is a group of like-minded CRA's (Consumer Reporting Agencies) who are concerned about the future of the employment background screening industry. We believe that certain data practices employed by some CRA's place our profession at risk.

Some employment background screening firms send the sensitive personal information (i.e. social security numbers and financial account information) off-shore to be processed. We believe that sending such information off-shore places both applicants and employers at risk and should be avoided whenever possible. Alternatively, when personal information is sent to other countries, applicants and employers should be made aware of this practice.
In addition, some employment background screening firms sell "national criminal records databases" to employers without appropriate safeguards to ensure that the information they are delivering is accurate and up to date. We believe that criminal records databases are valuable sources of information if they are used in a responsible manner.

We are concerned that these practices do not appropriately protect employment applicants from avoidable harm. Likewise, employers are placed at increased risk of litigation and public relations problems when their employment background screening partners employ these practices. Ultimately, we are concerned that ongoing media coverage related to errors in background checks and the potential for litigation and overreaching legislative solutions place our profession at risk.

There are lots of background screening companies out there. That means that there is considerable variation in the rigor and quality of a background screening. Here are a few things to look for in a background check company to help you discover which are the keepers.

1.) How extensive are the instant searches?
- do they start with an Address history search?
- Are all states and counties accessible?

2.) Are all searches instant (database) searches or do they also employ a nationwide network of court researchers that can enter and research federal, state, and county courthouses?

3.) Most companies offer bundled pricing for bundles of searches. Can you create your own bundle of searches that matches your need or do you choose from a list for best match?

4.) Are they compliant with applicable law (FCRA, FACT, etc.)?

5.) Who validates the background research reports? Do they use licensed private investigators, or someone less qualified?

6.) Do they keep your data safe with strong information security (PCI-DSS, ISO-27002, etc.)

7.) Are they member of the National Association of Professional Background Screeners (NAPBS)?

The answers to these and related questions can be very helpful in discerning the winners from the also rans.
