In the many many years I've been in HR I've only had to rescind two employment offers, and they were for reasons so very different a template letter would have been completely unsuitable. And unnecessary, given the low rescind rate. If you're rescinding so many employment offers that you need a template, maybe there's something wrong with your hiring process. |

I have had managers offer employment without going through the right process first to determine if they were suitable. In those cases, I have sent a general letter stating that after further consideration, it has been determined that you do not meet the qualifications necessary for the position. We wish you the best in all of your future endeavors. |

Can anyone tell me what legal issues might be involved with rescinding a job offer? Our CEO jumped the gun and made a verbal offer to someone who we ultimately may not want to hire. Ethical considerations aside (and we do recognize that THEY are considerable)can a recission all by itself be considered actionable? Or only if it has caused actual damages to the job candidate...like they quit their job based on the verbal offer and can't get it back. |

Was the offer accepted? If not, depending on the language of the offer, then you may be able to legitimately withdraw the offer. If accepted, then you should be concerned about the doctrine of detrimental reliance. I trust this is helpful. Dave Arnold, Ph.D., J.D. |
