Do any of you hire temporary employees direct (not through an agency)? If so, do you have them sign a contract of any sort? Thanks!

Absolutely a good idea. People only hear what they want to hear in an interview and a solid temporary offer letter which specifically outlines terms, conditions and expectations can head off a lot of disputes down the road.

Yes, we do hire people on direct contract. The contracted people will sign a Non-Disclosure Agreement (as in the case of a normal employee do) and Terms & Conditions of the employement.

The requirement changes accordingly to the local laws. Therefore, it is important for you to disclose the country in which you are hiring so that the respondents can specifically answer questions.

Temporary Workers

Some staffing agencies don't require the company sign a contract for temporaries. In those cases you can hire the temporary from the agency. However, its best to ask the temp to review their agreement with the agency. Many agencies include an agreement on the employment application that states the temporary cannot apply for a position with the company directly for a specific number of months. Others require the employee work a specific number of hours. Its best to check these things in order to protect the temp and its ethical.

We hire temporary associates that are considered "on-call" associates. They do sign an agreement saying they understand the terms and conditions of their employment. A word of warning...in some states temporary or on-call employees can work for you while drawing unemployment if their hours drop below a certain level. It can play havock with your experience mod.

Yes - by all means. We believe it is vital to sign a contract and in our consultancy business we require the non-disclosure agreement as well.
The NDA is signed with temporary helpers too, even when they are rented from a temp agency, who is responsible for their work contract.

The temporary employees we hire that don't come through an agency are given an offer letter indicating the position they are being hired for, the hourly rate of pay, hours/days the person will be expected to work, and the start and end dates of the temporary assignment. We also ask temporary employees to sign a confidentiality agreement.

This is nearly exactly what we do. All candidates sign a Non-Disclosure Agreement, and we also have a modified Proprietary Information agreement for temps.

The responses I believe are on the right track. But let me add one other "hurdle" you might need to consider. From a tax perspective, the IRS has been looking more and more into hiring temp employees as independent contractors. If you hire a temp directly and do not provide employee benefits or withhold taxes, I recommend that you make sure you can pass the independent contractor requirements. There are 19 different requirements that must be met by the IRS to hire someone in this status. It's never easy ....
