Our company has a policy of discontinuing job interviews

if the applicant is unable to provide a phone number for us to get a verbal referance from the previous employer.
The other day a job applicant said his reason for not giving a phone number was because he had a personal grievance which
went to mediation, the details of which are
confidential by law. We have decided to discontinue the interview for this reason
and would like to know if we have acted lawfully here or is it likely we could face
a defamation suit for passing an incorrect judgement on the applicant.

Any advise much appreciated

I can't answer that. It is a very thin line, I think, between being legal and illegal when it comes to disqualifying applicants. The applicant told you the truth, perhaps not wanting to lie because if you did the check and found out why they left, you wouldn't hire them because they lied on the application. Now because they told the truth, you don't want to hire them. Let's face it, there are unethical employees just as their are unethical employers. Perhaps this employee was asked to do something unethical and was given the do it or leave speech. Perhaps sheer frustration with the organization led them to being unhappy and difficult to work with. Perhaps they are by nature an unfriendly/unhappy person.

It is a difficult one because the candidate
showed us evidence of 20 years service and
written evidence of good performance but
told us the issue was about policy change
creating an unsafe workplace that effected
their specific role only.

If you're going to create a rigid, arbitrary standard like that one, then you have to resign yourself to losing good candidates and having headaches if they challenge the vailidity of your actions.
