I am new to the recruitment side of Human Resources. My employer would like to charge propective candidates a fee to run a background check on them, which would be reimbursed if they are hired and remain employed for 90-days with the company.

My Question: Can they do that? Is this standard practice for companies? I would have thought that running a background check on a candidate would be part and parcel of the normal recruitment costs. If this is out of the norm, how do I communicate that to the boss?

Appreciate any advice/assistance I can get.

No, it's not common practice. I dont know for sure that it's illegal per se (there may be some local or state ordinances prohibiting the practice), but I doubt you're going to get many takers. Most applicants, if faced with a $25 bill just to apply, will likely tell your boss to stuff it.

If you are paying more than $20 to do a 7 year federal and/or county felony check, you would be better served to find a lower cost background check provider.
