We are on the verge of getting our first government contract and I have some familiarly with AAP plans an the process as I used to do them many “moons” ago. I been refreshing myself with the latest regulations from the OFCCP and here is my question related to the “definition of an applicant”
I found this excerpt on the DOL’s/OFCCP website regarding “consideration” of candidates: http://www.dol.gov/esa/regs/compliance/ofccp/faqs/iappfaqs.htm#Q1JS What is the definition of an "Internet Applicant" in the final rule? An Internet Applicant is defined as an individual who satisfies the following four criteria: 1. The individual submits an expression of interest in employment through the Internet or related electronic data technologies; 2. The contractor considers the individual for employment in a particular position; 3. The individual's expression of interest indicates the individual possesses the basic qualifications for the position; and, 4. The individual at no point in the contractor's selection process prior to receiving an offer of employment from the contractor, removes himself or herself from further consideration or otherwise indicates that he or she is no longer interested in the position. MY QUESTION #1—the way I read this, all 4 points must be met correct? Also, in the section that describes what “Consideration of Candidates” means(point 2 above), it says: “A contractor may establish a protocol under which it refrains from considering expressions of interest that are not submitted in accordance with standard procedures the contractor establishes. Likewise, a contractor may establish a protocol under which it refrains from considering expressions of interest, such as unsolicited resumes, that are not submitted with respect to a particular position.” MY QUESTION #2--Does this mean that we could establish a protocol to “consider” candidates (ie, define how people must apply to our positions to be “considered” can applicant)? For instance, if we said that to be considered an applicant you must: 1.) apply to a specific open position, 2.) submit a resume or application form and, 3.) meet the basic qualifications for the position? So, if people don’t meet follow our stated procedure for being “considered,” they are not satisfying our established protocol we don’t have to “consider” them an applicant?
