Can we ask the following questions on an application in Texas & California?

Are you a citizen of the United States? yes or no

If no, are you authorized to work in the U.S.? yes or no

Unless you have to establish citizenship for export control or security reasons, I'd change your question to simply read "Are you legally able to live and work permanently in the US?" National origin is a protected characteristic; this question takes that discrimination potential out of play.

Hi:
According to the California Department of Fair Employment and Housing, the question about citizenship is unlawful. However, inquiries regarding legal right to "work" in the U.S. are acceptable.
