I was wondering if anyone has heard of having potential employees paying a $100 deposit in case they do not pass their initial drug screening for hire?

Moreover, is it common for the employer to KEEP that $100 (even though they passed the drug test) until they make it through their 90 probationary period. If the employee makes it to their 89th day and is then terminated because they "aren't the right fit" that employee's $100 is not returned to the employee.

I am inquiring because this policy has been implemented recently at our company and I am unsure of how reasonable it is. Before I proceed any further, I was hoping to hear if anyone else is doing this - it would at the very least ease my mind.

I have never heard of such a thing.

I believe you should have faith in the person you are hiring. You always go out on a limb when you hire someone. If it cost you $100 to do a drug screen and the applicant fails, it was probably money well spent.

If I were to be an applicant at your company and you asked me to pay the $100 for the drug screen, I would think that you are probably financially unstable and I would not continue to consider you as my future employer. I believe your company may lose potential hires because of this policy.

If your state has enacted drug testing legislation it is imperative that you review such statute. Under certain state statutes this practice would be unlawful.
