There is a new certification testing available in the technical staffing industry that I work in. As manager of training, I have been asked to make this testing a mandatory requirement for all existing and new staff in my company. The certification is not legally required for people to take in order to work in our industry, but my company wants to use the certification as a way to differentiate itself from other agencies. My question is, does anyone know if there are any legal ramifications to requiring that existing staff take and pass an exam in order to continue employment in a privately held company?

Your question sounds like a matter which should be referred to your company's legal advisors. But perhaps legality is not the only issue involved. Also consider: Does it feel ethical? How will it affect morale? Some people will probably take pride in having the opportunity to "strut their stuff". Other people who really know their stuff might not "test" well under pressure - and jumping through new hoops to keep your existing job can certainly feel like pressure!
If you offer "Certification Prep" training it might help any nervous existing staff members understand that the company's goal is to create winners, not weed out losers.

Points to Ponder:
With current employees, you can't change the rules midstream, and you would have to announce such a change. In addition, what would you do if employees fail the test which may not be a requirement for continued employment?
With NH's, if this test is required for the job, no question. If not, I would not try it. You may end up with a discrimination charge of some ridiculous kind.
Consult an attorney if available.
