Marriage Affidavit for Health Insurance

A current employee has applied for health insurance for his wife.  There is marriage certificate as they were married in a country that does not commonly issue certificates. 

We administer our medical plan, and have been advised that the typical solution is to obtain an affidavit of marriage from the employee and spouse with an acknowledgement that misrepresentation is cause for termination and/or recovery of costs.

Has anyone come across similar issues - have a sample affidavit?

You could, but what about common law marriage?  No certificate would be issued in such a case. In some states, such as Colorado, common law marriage can be as easy as simply giving the appearance of being man and wife; in others, it requires a certain period of co-habitation.

Absent a certificate, can you ask for this year's tax return?  Filing jointly should be enough. What marital status does the employee claim on his/her W-4?

Questions:
1. Why is there a delay between applying when first employed and applying now?
2. What coverage/how was she covered before this?
3. How do you handle people with pre existing conditions?
4. How do you audit dependents for legitamacy? Dependent coverage fraud has been and remains a fertile area for reducing benefit plan costs.

Depending on your responses to these questions I have follow up questions.

All good questions.  Fact is--I don't know the answers. I have nothing to do with administering benefits. I was merely asked to make up a form for those who have already determined that they need it.
