OTC Flex Eligible Expenses

I was under the impression that over the counter items were no longer eligible (unless the doctor wrote a prescription for those items) as of last year under Health Care Reform.  Now I find out that certain items are, according to our vendor.  Those items include alcohol, peroxide, denture adhesives, bandages and thermometers.  I was told this was because they are OTC items that are "clearly not medicine or drugs".   When did this take place?

Hey elly - check out this link:  http://www.shrm.org/hrdisciplines/benefits/Articles/Pages/ReformOTC.aspx. Notice 2010-59 goes over the rules.  Necessary medical expenses other than drugs were not affected by the reform.  I would recommend having your FSA vendor supply a communication piece for your employees on this topic.

Effective January 1, 2011, as a result of Health Care Reform, a written presciption is required for over-the-counter drug items (Tylenol, cough medicine).  A prescription is not required for non-drug items such as bandages.  It is always good, in communicating to your employees during open enrollment, to include vendor brochures that will help in clarifying changes.
