Unemployment from a Former Employer

I have a employee who works at my company and this individual wants to quit and collect unemployment from his former employment. Is this possible in the state of CT? I told him that if he wants to quit, I will help him find this out. Anyone know anything about this?

Generally speaking, a person is not eligible for unemployment benefits if she or he voluntarily quits employment. There are some exceptions, however, which would be based on a "reasonable person" basis.  For example, benefits may be awarded if the person quit employment because the employer moved the workplace such a distance as to involve an unreasonable commute. Another case in which benefits might be awarded might involve the relocation of a spouse out of state and the person quit to be with the spouse. 

Voluntary resignations of employment will often result in an initial denial of unemployment benefits claims. The employee may appeal, however, and present her or his case to an administrative law judge.

Sorry, one more thing.  You say that this person who wants to quit from another company is working at your company. If this person is working, then there would be no basis for claiming unemployment benefits.

I would stay very far away from offering any guidance to this person. I am also not sure why you want to encourage this kind of behavior.

This person has a job but wants to quit to live on the dole? does that sound like a motivated employee or someone you want at your firm? Not me.

Even if he/she is eligible because they were forced to resign and therefore eligible, why leave a new gig?? If you want to over some advice I say tell him to move forward............

If I am missing something please explain and will be happily corrected.

Just realize that if you help him, it could come back and bite you when he works for a little while for the next employer and then quits and the unemployment benefits get charged back to your account (because wages he earned with you are in the calculation period).

I don't know CT, but I wouldn't encourage this. You as a third party have no standing. If you were allowed on the hearing, all you can state is the records you have at your company. No good will come from you getting involved.  And it might be possible for you to be liable in a fraud case if they found out that anything you stated was incorrect.

He is a seasonal employee and he knows that his time here is going to end soon. I informed him that he should just stick it out till he is let go but he is insisting that he leaves before he he is let go. I told him that would be a dumb idea

What is his reasoning for leaving early? won't he lose some layoff benefits?

The ee knows what is going to happen and he just wants to hurry up and have it happen. I told him to stick it out for a few more weeks tops and then he will be all set.
