Late payroll submissions

We have an electronic timekeeping system and pay every other Friday for the two weeks ended the previous Sunday. In order for our payroll office to properly audit and transmit payroll data to our 3rd party processor, we've established a Monday noon cutoff for all payroll data submissions. Our staff and supervisors are unfortunately notorious for submitting late payroll data to us on Tuesday and even Wed and then expecting us to pay on Friday.

If payroll data is submitted for the pay period just ended AFTER our established deadline, I believe we are required to pay the employee anyway. We're CA-based. Can anyone clarify this regulation for me and let me know how you've dealt with this problem? Thanks so much.

You're correct - you're obligated to pay for time worked. The obligation to collect payroll data is on the employer, not on the employee to provide.

I would treat this as a disciplinary issue.

I send one direct deposit batch per payroll...period. So late timecards mean that the employee will get a live check instead of a direct deposit. When the employee calls me to complain, I refer him or her back to the supervisor who turned in the late time. Since the supervisors have to deal with the employees complaints, late info is now a rarity.

And yes, you still have to pay the employee, of course. But CA law requires employees be paid at least twice a month. If the time is late, you can pay them late as long as it's within the month.
