I'm jumping in here a bit late, but I'm confused. I understand that it would be a qualifying event if he lost coverage, so he would be able to join his employer's plan, however I don't understand what that qualifying event would be that would allow his spouse's company to drop him in the middle of a plan year.
Also as a side note, my company (self-insured) does charge an additional $200 per month to insure a spouse who has coverage with their own employer but chooses to be on our plan instead. Out of over 3000 insured employees, only two pay this premium, which makes me believe that it probably is saving us money. Of course we really have no way of monitoring whether or not a covered spouse does have his own insurance option.

Ellymae, I suspect it is due to an upcoming open enrollment/renewal period if they are calendar year. I bet the company/insurer is doing an annual audit of the plan and its rules. They might not be able to drop him immediately UNLESS there was a rule in the plan that they are breaking.
If the employee was required to show spousal coverage/benefits at another job, didn't and it is found in an audit, they can be dropped.
But I think it would all depend on the plan document/insurance contract/SPD

Fro the conversations above -Birthday rule: If a child is covered by two parents under two plan. Which parent has their birthday first in the calendar year ( example: Feb 5 over Sept 10th? The child is primary with that Feb 5th parent and secondary with the Sept parents plan.
