Another 30 days to enroll after Open Enrollment?

We just finished an active Open Enrollment period that included a medical/dental carrier change. Our OE period was 6 weeks long. Our new carrier just told us that Florida law requires us to give employees an **additional** 30 days after the insurance effective date (7/1/2011) to enroll in the new coverage because it is a new plan/carrier. I've never heard of this before. Before we call our benefits attorney, does anyone know if this is true?

I'm not overly familiar with Florida insurance law, so I would suggest asking the insurance carrier for documentation on this. They have more to lose than gain by going this route, so I would assume they aren't wrong on this. Then again, nothing really surprises me these days.

I am not absolutely sure on this one, but my radar is going off on the taxability issue.

You might need to check that if an employee does enroll late, if there is a chance that the Section 125 requirements for a pretax deduction will NOT be met (because the employee must make the election prior to the start of the plan year or within a certain # of days of hire).


As for the eligibility issue, I would agree that there would be no good reason (other than law) for the insurance carrier to state this. You might also check your contract/any information you received from them such as an SPD/plan document, etc. If you didn't get it in writing, I would suggest that you do and ask for a specific reference to the Florida law/code that states this.
