Hello,

I have the ex-wife of a former employee calling me for information regarding her ex-husband (our former employee).  The ex-wife is asking me for a letter stating whether her ex-husband quit or was fired from our company.  Am I required to give her this info?

Thank you.

Absolutely not! I had an ex-employee I fired due to embezzlement....his mother-in-law came into the store on multiple occasions to confront me and ask why he no longer worked for me. I think he had told his wife that he was let go due to health issues/not being reliable which if that were true, he'd be able to collect unemployment and probably sue us as well, so I think she was digging for info on why his unemployment paperwork didn't go through.

I told her (and what I recommend you need to tell this woman) is that I couldn't discuss that matter with her, it was an issue she needed to bring up to him and ask him to be honest. I know in my case I could have told her why he was fired and there's not much legal action they could take, as he admitted to stealing once caught. But in your case, you never know what he might retaliate with if you release information.

Don't let them pull you into their family drama. Ask the woman to stop contacting your company, and start speaking to her ex for answers.

I can also tell her that the court can send me the documentation and I will respond directly to them.

Thank you.

Agreed I would wait for the court to ask for the information via a court request or a subpeona.  It is never good to get into the middle of family related issues.
