If Mgmt asks you to do something unethical...

Hypothetically, of course... If your manager asked you to do something that was considered unethical within the industry...such as an in-house recruiter asked to raid other companies for sales personnel...what could you do?

Don't do anything you feel, or know, is unethical. The fact that you are uncomfortable indicates you should remove yourself from the situation as quickly as possible. Tell your manager that you can't go along with this request, and explain why. If you are coerced after your refusal, talk to an attorney. If you willingly become involved in unethical activity, and the situation is later uncovered, you, not your manager, would likely suffer the consequences.

I appreciate your input, however, I guess my real question is, do you believe the industry considers raiding another company for recruits unethical and why? How can I convince my manager that I should not be asked to do this, when s/he wants candidates at any cost?

The question not only involves ethics but legal ones as well. Recent court cases have involved the raided company suing the "raidee", particularly if confidentiality agreements are involved. Search this website and others to obtain the legalitites of company raiding. This may be the key to have your manager back off.

I don't recall what industry you're working in, but I doubt there's anything illegal about recruiting from a competitor. "Raiding" may be a different issue if it has potential to get into unfair practices, monopolies, etc.. But as far as I know, its still a free market and you can recruit from whomever you'd like. However, if employees (especially management) who were previously employed by a competitor have signed non-compete/non-solicitation agreements - that would be a different story.
The ethical question is more 'real' in my opinion. In the industry I work in, our approach is to hire independent recruiters. We give them a profile we're looking for, and they recruit from whatever sources they can find -- that way, we're kept at arms-length away from direct recruiting. In your case, given you're discomfort with the request - I'd probably just appeal to your bosses' sense of company reputation -- it may not reflect well on your company if you're seen as violating an (unspoken?) industry non-solication practice! And if your customers consider reputation/ethics of their providers, your competitors could use the recruting thing against you.. That will only work, of course, if it really is an ethical consideration in your industry! Good luck.

Do not get involved with this if you are not comfortable. Having been on the downside of this situation before, discuss the situation with the manager and raise your issues with them. If they still want to go through with it, document the steps you have taken to advise against it and see an attorney. You do not want ot be part of something like that. Take my word for it!

It depend on your values.I would personally like to avoid such things.
I am not sure whether most of you would agree (It was not taught in our business schools) that it is expected that an HR person should usually wear the martyer cap.There is sometimes a very thin line between a ethical and a non -ethical response. You may chose to be on either side. Clever HR people handle situations and still remain ethical at the end of the day. Now let me put forth few more situations :

1. An employee was hired with an understanding that he is entitled for certain benefits which the offer letter specifically excludes. The line manager is not too keen to extend the benefit .
How will you react .

2. You have hired a college trainee for internship work . The manager wants him to do regular office work as well. Do you think it is correct.

3. The local labour laws disallows certain employment practices. You have found some loopholes and you are confident that you can avoid a legal tangle if you get into trouble . Will you accept the underlying priniciple of the law or continue to take shelter under labour law.


If you really like HR ,you will come across many such situations and you will have to strike that delicate balance.
