I work for a small company who does not have a 401K put into place. Where can I go to set up a 401k. Also, since we do not have a Human Resource Department, I am starting from scratch. Are there any websites with detailed information on starting an HR department.

Do you have a payroll service, i.e. PayAmerica, ADP, Paychex, etc? They can help. Otherwise, talk to your accountant, or your broker, or your insurance agent. You can also get a referral from www.shrm.org (Society for Human Resource Management), who can also probably give you info for setting up an HR dept.

Might I enquire what your role is in the company? It is very hard to just go to a website to learn how to start up an HR department and it is impossible to do a new 401(k) this way.

Both of these areas are very technical and you can't guess with all the legal liabilities.

Is it considered a "conflict of interest", if company hires an employee's spouse to be account rep for the company 401K plan?

Why are you not posting this as a new question instead of tagging on to a 12 year old question??

Exactly what will the account reps duties be?
Who is the plan administrator and what is the employee or spouse's relationship to the plan administrator?
What are the plan monies being invested in and does the account rep's compensation tie in any way to her role? if yes how?

Why not hiring a financial adviser?  Such people are the most capable of giving quality advices.  Planning retirement is highly important and I am sure you do not want to end up applying for one of those payday loans online simply because you did not properly pay attention to the 401K  when it was extremely necessary, you know. Therefore, you should better get a qualified assistance. Did you try to ask this question your boss or whoever is in charge of solving such issues?

Possibly a conflict of interest, possibly not. Agree with Howard that it depends on what the employee's role is.   What policy do you currently have for CoI?   I personally would not do so at our group of companies. I might give the business to that administrative recordkeeping/financial company but have a different client representative so as to not mix personal and business issues.
