Domestic Violence Policy for Handbook

We are just finalizing an employee handbook for our staff. We'd like very much to include some kind of policy statement on Domestic Violence. Rather than re-invent the wheel, I was hoping someone who already has a developed policy statement on this subject that's appropriate for an employee handbook would be willing to share their's. I would greatly appreciate the assistance.

Where are you thinking of going with this? I don't know if you can do anything about employees who (unfortunately) commit domestic violence, as long as it doesn't affect their work or that of their coworkers. If you want to provide assistance for employees who are victims of domestic violence, your company EAP probably covers that.

I second cpackham's opinion. At our company, we try to stay away from your employees' private life's unless their behavior hits the work place (i.e., the spouse calls you to tell you about it, spouse is harassed or abused at work, etc.) When this happens we suggest the employee or spouse to visit a professional counselor, to call their health insurance C.S.# so they can get coverage information, and give them as many websites, books, and city or state agencies names or numbers so they can try to solve their problem themselves.

Albeit domestic violence is a growing concern, you do not have any right to implement such a policy for employees.

Focus on your internal harassment or violence in the workplace policies. Unfortunately you would not have a leg to stand on with domestic issues, they occur at home, not at work. That makes it a private affair.

This would be really helpful for the families of your employees. Domestic violence is common on many families. Heterosexual females in households where both partners work experience domestic violence more frequently than do unemployed females who stay in your own home, according to brand new research. In reality, they do so more than twice as often.

Kenny-Not sure I understand your logic. Are you saying you think that having an employer stating that there is a policy against domestic violence would influence an employee not to do domestic violence? What is the penalty if there is domestic violence? Firing the employee? Then what ? The employee is now at home and unhappy because of this policy. Do you think this will improve the homelife situation??

Employers just cannot get involved in this quagmire EXCEPT if they suspect their employee is involved in domestic violence they can provide information on the companies' Employee Assistance Program.

Julie, I applaud the fact that you are taking a step that many employers are afraid to take, or don't understand that DV is Everybody's Business. It costs business over $5 bil/year in added health care costs, causes the loss of more than 32,000 FTEs in lost prodcutivity, and is the leading cause of murder in the workplace among women. An excellent resource sponsored by the Dept of Justice can be found at http://www.workplacesrespond.org/ . (They have a tool for wrting your policy in about 15 minutes.) Additional resources can also be found at www.caepv.org.

From SHRM:

Employers can help victims of domestic violence by taking the following steps:

Encourage the use of company employee assistance program or community
resources focused on domestic violence. HR professionals should avoid trying to
counsel the person.

 

In states that permit employers to obtain restraining orders covering
the workplace, evaluate the feasibility of obtaining such an order when threats
from an employee’s abusive partner affect the workplace.

Limit or bar the abuser’s access to the workplace, such as
distributing the abuser’s photograph to security personnel, members of
management or the employee’s workgroup.

Take additional security steps such as providing an escort to the
parking lot, providing a parking space close to the building, offering flexible
or varied work hours, removing the employee’s name from the office directory,
screening calls and changing the employee’s work e-mail address.

If the employee refuses help or denies that any abuse is going on but
the employer still suspects that the employee is being abused and that the
abuser might come to the workplace, then the employer still has a responsibility

to protect the employee and co-workers on the premises.

Employers should be aware that several states have passed laws protecting the workplace rights of victims of domestic or sexual violence. Before taking any type of action against an employee suspected of being the victim of domestic violence, employers should carefully check the laws in the states where they do business. Even in states that have not passed such laws, employers should establish written policies on leave requests and related issues.
