I'm looking for some advice about employees who take second jobs that may conflict with current job by way of responsibilities and/or soliciting extra "side" employment while in the field. We have no problem with employees needing to supplement income but...

The employee in question works as bilingual outreach staff for us (a small nonprofit) but is doing translation/interpreting in the community free lance.

Concerns that come to mind are that she may (mis)represent us in the community and her skill base/competency may go un-checked and be associated with our organization's name.

If she's freelancing in the same community served by your organization, I can understand your concern. How would her clients distinguish when they are receiving services from her as your employee, vs. when they are receiving services from her as a self-employed individual?

This isn't an issue of having a second job per se, but of using one's job to solicit business for oneself. If you don't already have a non-solicitation policy you should put one in place - SHRM probably has some good models.

If an employee becomes ill as the result of his second job, is it appropriate to tell him he may need to think about quitting his second job?  He will be out a couple of days and sometimes asks to leave work a few hours early because of the other job.
