OK then the US company has to abide by all Canadian employment and tax laws, including paying the employee in Canadian dollars. To do all this, the US company will have to incorporate itself in Canada and then employ the Canadian through it's Canadian entity.

On a side note, I don't understand why you're doing this investigative work on behalf of the US company. Why are they making you (their customer!!!) do work for them...and why are you agreeing to do it? I don't do free work for my vendors...

you nailed it. the reason is because they would rather get this hire in india(across the globe) than in Canada. We want to make the case that hiring a Canadian working on-site is more cost effective and efficient than going to india.

Thanks for the info. Really appreciated. I guess by going the employee route, it is much more trouble for them to do than going with IC. I guess IC is an option as well.

In terms of health insurance, US vs Canada. I found on http://healthinsurance.about.com/od/healthinsurancebasics/a/cost_of_health_insurance.htm. US's health insurance is 1-5 times more than Canada's, is it roughly accurate?

Going the IC route is only an option if the job can be legally classified (by CRA and the appropriate Ministry of Labour) as IC work.

American health insurance applies only to Americans working in the US. Canadian health insurance applies only to Canadians working in Canada. Neither American or Canadian health insurance applies to Indians working in India.

@ hrbth, you seem to have all the answers - can I please ask you about a related but different situation - a canadian citizen employee working for a canadian company while living in (and completing work remotely from) the United States. Is the employee subject to amercian employment law requirements/stat holidays, or canadian?

First, there are no stat holidays in the US.

Is this Canadian living legally in the US? What kind of visa does he/she have?
