I've been doing lots of searching here and in general and cannot find an answer despite the many posts regarding attendance policies. Therefore, I am opening a new thread on this topic.
My question is this: Can we have 2 separate attendance policies?
Here is the background:
We have a call center and claims dept. that need to be manned from the time they open so punctuality and attendance are very important. However, punctuality in particular is not as big of an issue in other departments where the work can be made up later in the day. We have had a no-fault attendance policy but found the manager in one department changing start times and allowing EEs to come in at any time before the scheduled time and leave before the scheduled end of the shift. At the same time, EEs in the other departments were being disciplined for being late. I have stopped the discipline until we can adjust our policy or at least address the fact that it's not evenly administered.
Although it seemed easier to administer the no-fault system and I thought based upon input from managers when I took this position that it would work in all the departments, I'm finding that is not the case. An excused-based policy would help with the absences since most have been for legitimate reasons. I know there are underlying factors that would need to be addressed to curb the problem, but does anyone have feedback on having 2 different policies? Or should we just have a disclaimer that each situation of excessive absenteeism or tardiness shall be evaluated on a case-by-case basis? It just seems like that opens us up to wrongful termination or discrimination suits.I would be afraid that if we let someone go due to attendance violations, they could say that we didn't let someone go who had more violations. Would we be able to use the defense that punctuality wasn't an essential work function in one department.
Rambling...Any suggestions?

I would keep it consistent within each dept as each dept has different needs. As long as you can justify those needs, you are probably okay versus discrimination cases between departments.
But yes, you can legally have different policies. You could also base it on other factors such as length of service, etc.
One thing I would try to look at though is whether the differing policies have unintended disparate impact. For example if all the employees in customer service are ladies and all the management are men and you are unintentionally applying the policy to ladies only because they are all in that dept.
