I am hoping that someone can help me answer this question. One of my supervisors caught a gentlemen sleeping on the job. We suspemded him for 3 days pending management review of the situation. However

I am hoping that someone can help me answer this question. One of my supervisors caught a gentlemen sleeping on the job. We suspemded him for 3 days pending management review of the situation. However the very next day the GMP union become the bargining unit for the employees here. Will we be able to terminate the gentlemen since there is no union contract in place yet.

A straight answer is yes you will be able to terminate. Will it be easy or simple? Probably not but that depends upon the evidence in place and your CURRENT policies and procedures. Also, how you have addressed these in the past will play a part.

You just earned a union so it is evident employees are dissatisfied about something that incumbent management is or is not doing. I would simply ensure that you dot the "i's" and cross the "t's" when following your existing policies to the letter.
