What does your company do to differentiate between employees and independent contractors. Do you have different offer letters, diffent levels of IT and building access. Are contractors allowed to attend company functions.

We do have a general policy called "Categories of Employment" where we define each type we have (part time, full time, temp, and so on) and what benefits each type is allowed. We also define ICs - and state that they don't get pretty much anything - in that policy.

You'd be well-advised to consult with your legal counsel. There's an entire body of law that regulates independent contractors as opposed to general employees and you want to be sure you don't cross that invisible line with the contractors - particularly becuase you may end up being liable for their negligence if the courts determine they were really your employees - even if you had no such intention.
