An employee came to me today because she thinks she overheard another employee say that Asian's are the worst drivers while in a conversation with 2 other employees. The employee that came to see me was not part of the conversation but could hear them. He isn't sure that is what he heard. I told him to talk to the person that said it to clarify if that is what was said and to let her know that it bothered him. Our policy says that harassment on any protected category will not be tolerated. What would you do in this situation? Talk to the employee that might have made the comment and see if she did and let her know it is inappropriate or encourage the employee who complained to talk to her if he feels confident that is what was said? Thanks.

Even if the person did say that Asians are the worst drivers, all you have is an inappropriate comment. You don't have anything near a harassment case.

That said, inappropriate comments shouldn't be tolerated either. I recommend that you speak to the offending employee's boss and if the boss thinks that is something that employee might say, coach the boss in reinforcing with that employee (in a non-disciplinary way) the fact that inappropriate comments like this aren't tolerated.

I agree with HRBTH. All you have is a "I think I heard" allegation and not much else. I would counsel the employee about your zero tolerance anti-harrassment policy and let them know that you take their concerns seriously and will investigate if this persists or more substantive evidence is present. At this point I hear an over sensitive employee and thinking they heard something doesn't help their credibility. Knowing they heard it might make a difference.
