Dear Forum members:

We received this note via the Workforce Management editors' mailbox, and after discussing it with the sender, I'm posting it here. I know that the forum isn't meant for employee questions, but I'm hoping you'll make an exception, as you've done in the past. If you have any suggestions beyond the FMLA question posed here, please feel free to make them. I'll forward the responses to the writer.

"I live in Tennessee and my workplace only employs 7 employees. I have worked here for many years and now my husband may have to have a bone marrow transplant due to leukemia. This business is an independent pharmacy and my position held is a certified pharmacy technician. My question is am I eligible for FMLA and would my employer be responsible for paying my health ins. premiums as they do so now?

Unfortunately, your employer is too small to be covered under FMLA and there's no Tennessee FMLA law of which I'm aware that would provide similar coverage.

Because you've been employed there so long, I would recommend that you talk to your employer about the situation and explore what accomodations they might be able to make in your case. Even being able to continue your health insurance at group rates would probably be worth it for you even if you were to pick up the premium cost.

Agree with Nork....I wish I had better news for you. Hopefully your employer will work with you and work out a way for you to keep the insurance. Unfortunately COBRA coverage is for companies with more than 20 employees.

My source shows Tennessee has a 3 month state continuation program (that mimics COBRA) and then has a conversion coverage.

That site does a pretty good job giving you the basics of conversion coverage, but basically it sounds like it is just an individual plan, which means it could have different coverage amounts and a different premium. But it does guarantee renewability which might be huge based on your husband's medical issue.
