Well Montana now has a medical marihuana act.
I was just wondering if anyone else is in a state that has this and how they have dealt with it in their employee handbook. Do you address it at all? D

Not much argument in favor of accomodating unless you have a family member dealing with cancer and Marinol pills are a necessary part of treatment.
I have known two people who relied on Marinol to get them through an awful period of cancer treatment. Not sure either would have been able to work at the time (one was a teenager) but I would have been open to it.

During her cancer treatment phase, my mother became a completely different person when she started using pot to combat the side effects of chemotherapy. (And just for the record, she was 58 at the time and extremely conservative/right-wingish.) Before the pot she was either passed out stone cold from the prescribed side-effect-combatting medicine, or she was wrapped around the toilet retching her guts out (literally - she developed a bad hernia from this). After she started using a very small amount of pot per day (basically one big puff in the morning, and one more at night before bed), she started eating regularly (and keeping it all down), walking around, doing light housework, going out with friends, shopping, swimming every morning, you name it she did it. She and I are both convinced that the little bit of pot she used every day for about two months ultimately saved her life.

I don't believe the debate was about efficacy. I'm certain we all have personal examples to share. The effectiveness of the treatment does not negate the concern employers face with the use of the drug in the workplace. This can be true of many drugs that cause drowsiness, mood changes, and other ill side effects impacting safety and performance.

I would not want to be the HR professional who advised their employer to accommodate a person using Mj. Most employers have reasonable cause/suspicion guidelines and most have alcohol/drug programs. Like HRPro indicated, let your policies do the talking or develop a policy.
I just can't see an employer following a legitimate policy, based on legitimate law and losing a law suit because of it.
