Just say no. People say no to smokeless cigarettes in the workplace everyday.

Decide whether by "no-smoking" you actually mean "tobacco-free." These present different issues: second-hand smoke/fire safety vs. general health/image concerns. If you want to ban all tobacco products -- in as well as all smoking -- you will need to reword your policy.

I'm unaware of any law that precludes an employer from banning both smoke and smokeless items in the workplace. We and other hospitality-industry franchisees have done so in accordance with the local health code. Suggest you read any local clean air code carefully for the specific language.

Doesn't smokeless mean no smoke? If the employee finds an alternative to smoking then are they not adhering to the policy?
The purpose of a no smoking policy to to reduce fire and health risks for reasons of insurance and the comfort of other employees hence improving company efficiency, correct?
If the employee is not negatively effecting cost or efficiency, then the question becomes this... Has the "smoke" issue become a control/domination issue?
Control issues can cost unnecessary time and money as well. It is true that the boss can make policy as they see fit but policies for the purpose of needlessly reminding everyone who the boss is can misdirect company resources into bolstering supervisor egos. This kind of policy making is best left to the company owner.
Of course, even if that's what is happening, the employee should follow the rules. Insubordination is insubordination. The control thing is a separate issue that will manifest itself again and again in other forms and be dealt with accordingly if and when it interferes enough with production to warrant such.
