We have two emps that have brought in exercise balls to sit on at their desks. If they fall off and hurt themselves isn't the company liable? Can we make them sign a waiver so the company is not liable? thoughts?

Even if the company isn't liable, it will suffer if (actually make that "when") these two injure themselves - because their work won't get done!

Exercise your rights as an employer and tell these two to return their balls to the gym where they belong.

Yes, employees should not have balls at work.

If they get injured you will be liable under most states WC laws. You allowed it to occur and continue. Further you did nothing to stop it.

So, your concern is very valid and the employees should be directed to sit in the office furniture provided (absent a legitimate ADA accommodation) and told to take their balls elsewhere.

So you are saying that they are not allowed to sign a waiver of liability should they fall off this ball and get hurt?

They're allowed to sign it, but it's not enforceable.

Why are you even thinking of going this pointless route when you could just tell them to take the balls home and sit in regular office chairs?

That's what we're saying, Anderson. You can check with your WC carrier if you like, but I'm quite sure they'll tell you the same thing.

Late to the party, but WC rights can not be signed away, just like FLSA minimum wage/overtime rights.

It is up to the employer to set the policies and in this case, if the employer has an issue, then I agree, the employees need to be told no.
