I have an employee that had trained pay and I also paid a training manager. We are in an 'at will' state and she signed an employment agreement that stated if she leaved before 6 months that she would have to pay back a training fee. She quit 2 weeks before the 90 day and I want to take her to small claims court to get back the money we paid to train her. Does an employment contact in WA. cover me and trump the 90 day at will since she signed and new the cost when being hired?

It's going to depend on the details of the contract and how well it was written. It may or may not protect the employer. Honestly, since there is a contract, yes, that does trump 'at will' generally IF it is meant to. It is possible to have a contract that specifically states that 'at will' still applies. THat why the devil is in the details of a well written document.

I am not familiar with WA state laws enough to comment much more than that.

Unfortunately even if you get a judgement against her, it's always fun to try to get it paid back.

In the future, there are some other ways to handle the paying for training/reimbursement. One out of the box idea is to reimburse over time....so if they quit, they forfeit the rest of the reimbursement. Rather than the employer trying to recover it.
