The situation you describe will bite you in the end.

If you have made the decision to continue to work with this person, you shouldn't be doing it with the thought that you will replace her when it is convienent for you. It should be a clean slate.

Should you continue to develop others? Of course, but if you develop someone to take her place and then let her go based on something that happened in the past, you will send a message that it isn't "safe" to share knowledge with others. You already sent the message the she has power over you through knowledge.

When I was a boss and someone tried to manipulate me that way, I would send them home and do their work myself. When they returned the next day we would have a heart-to-heart talk. I would tell them that I valued their talent and that I was proud that they could accomplish what they could, but that it was more important for them to be a good employee than it was to be a good producer and that it was my job to make sure they were good employees and if they couldn't do that, we could get along fine without them. You have to take a stand.

It sounds like you might be getting into the woulda/coulda/shoulda realm here, which can be difficult to recover from. This person has broken the rules repeatedly in a self-described lenient or laid back environment. Just because they say the word "hostile" or "harassment" does not mean you can't do anything about it. Prove she was terminated for theft, violating computer/phone usage policies and poor productivity. If you run a clean, non-hostile environment, you'll be fine.

The decision of terminating an employee cannot be one that is made out of convenience. You are letting them run the show here, as well as signaling to the employees who DO perform good work and DO conform to the rules that this behavior is tolerated. She needs to go now, and tell her to take her smart phone with her.

You'll find plenty of other fish in the sea willing and eager to work harder than this one that will cause you less headaches. Good luck!

I agree with all the responders here. This is not a valuable employee who should be kept on despite her, ummm, bad habits? - this is a lazy lying thief who should be fired immediately. If I allowed such a person to stay on in spite of her behaviour, MY boss would fire ME. (And rightly so.)
