It would be easier to prove an IC status if they had a painting business, with business and WC insurance to cover themselves. Or if they were also doing other painting jobs at the same time. But lots of other factors come into play too. Generally your best rule of thumb is if it isn't a slam dunk to be an IC, make them an employee. |
