We are a manufacturing Firm that does work with the Military. We have 2 of our engineers who are on H1b status and working on getting their Permanent Residency. My understanding is they dont meet ITA

How does one hire to meet ITAR requirements? - 2 questions.

We are a manufacturing Firm that does work with the Military. We have 2 of our engineers who are on H1b status and working on getting their Permanent Residency. My understanding is they dont meet ITAR standards. IS there any way they can get certified?

2) Any specific verbiage we can add to our job postings that will meet ITAR conditions but at the same time wont be discriminatory? (Any suggestions from other similarly situated companies will be very very helpful). A big thank you for all responses.

Our company has been requested by a customer to comply with ITAR as we are a sub-contractor for military applications. We have hired an attorney specializing in ITAR complicance to help guide us with the proper procedures to meet the requirements. One of our marketing employees is on an H1-B visa. He is not allowed to view ITAR controlled documents. We were also required to have him complete a 24 item questionnaire attesting that he is not providing information on our products to foreign governments. We also had to update our Non-Compete/Non-Disclosure documents to include language addressing this issue, which he also had to sign and date. It is my understanding that this is not a discriminatory instance as ITAR is a federally mandated program. However, we will be using the new NC/ND for all new hires going forward.

I'm not sure if this helps or not. I would highly recommend consulting with an ITAR specialized attorney to be sure you are meeting all the required compliance issues as they affect your organization.
