One of our outside salespeople called in yesterday and said they were going to admit themselves into a two week alcohol rehab program.  Today, we find that they are unable to start the program until next week and have put themselves on medical leave (they posted an automatic reply on their email address.)  Question = can we restrict use of/take back the employees company automobile until successful completion of the rehab program?

Yes you can and should. You have a responsibility to protect company property and to reduce potential risks.
You should also advise the employee that they are not authorized to return to work, use company property  etc.

Given the potential for liability here, you should indeed take the company automobile.  Tort lawyers will go after whomever has the deepest pockets and that would be your company, not the employee. Until you do retrieve the car (send someone to get it), advise the employee in writing that she/he is not to use it for any reason.

Daily Q&A

How to Address Flagging Motivation?

How do I increase motivation levels in the department? How do I brand my business unit as an attractive place to work? I have top-notch IT professionals in my business unit who feel they are "children of a lesser God" because they are non-billable resources and do not get plum postings abroad, nor the glamour that goes with them. As a result, their motivation suffers.
