Do you know if a person going through a drug rehab program qualifies for FMLA? In other words is it a FMLA qualifying medical condition? I thought it did fall under the ADA? I think you need drugs

Do you know if a person going through a drug rehab program qualifies for FMLA? In other words is it a FMLA qualifying medical condition? I thought it did fall under the ADA?

I think you need drugs in order to understand the drug testing laws!!!

The ADA does not include current illegal drug users in its definition of an individual with a qualified disability. I hope that this helps you. It is also my understanding that FMLA covers serious illness's and pregnancy. I woul call your local DOL or the US DOL.

Substance abuse treatments are covered under FMLA; absences resulting from actual substance abuse are not.

ADA covers individuals who are not currently using drugs and who are going through a rehab program. It also covers those who are perceived to be in recovery provided that there is no continued substance abuse.
